These terms govern the use of the Pulsero website, pilot access and related services.
Acceptance of terms
By accessing or using Pulsero, you agree to be bound by these Terms of Service. If you do not agree with these terms, you should not use the website or any related services.
Use of the website and services
The Pulsero website and services are provided to facilitate pilot access, support and delivery of the classification service. You agree not to misuse or attempt to abuse the service, attempt unauthorised access to any part of the system, submit false or malicious content, or interfere with the operation of the service or infrastructure.
Pilot access
Participation in any Pulsero pilot programme is subject to acceptance, eligibility and availability. Pilot services are provided to allow estate agencies to evaluate the platform prior to commercial engagement. Pilot participants acknowledge that the service is in active development and may change during the pilot period, that pilot access may be withdrawn with reasonable notice, and that real seller enquiry data processed during the pilot is subject to a separate Data Processing Agreement.
Data processing
Where Pulsero processes personal data relating to sellers on behalf of an estate agency, Pulsero acts as a data processor and the estate agency acts as the data controller. This relationship is governed by a Data Processing Agreement entered into prior to processing commencing. Estate agency clients are responsible for ensuring they have a lawful basis to share seller enquiry data with Pulsero for processing.
Automated processing
Pulsero uses automated systems to analyse seller enquiry content and produce classification outputs. These outputs are recommendations only. The estate agency remains solely responsible for all decisions made in relation to sellers. Pulsero does not make autonomous decisions that produce legal or similarly significant effects on individuals.
No guarantees
Pulsero is provided on an “as available” basis. While reasonable efforts are made to provide a reliable service, Pulsero does not guarantee uninterrupted availability, error-free operation or suitability for any particular purpose. Classification outputs are indicative and should not be treated as definitive assessments of seller intent.
Intellectual property
All content, branding, software, methodology, designs and materials associated with Pulsero remain the property of Pulsero unless otherwise stated. No part of the website or service may be copied, reproduced, reverse-engineered or distributed without prior written permission. Seller enquiry data submitted for classification remains the property of the estate agency client.
Limitation of liability
To the fullest extent permitted by law, Pulsero shall not be liable for any indirect, incidental or consequential loss arising from the use of the website or related services, including loss of revenue, data or business opportunity. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence.
Governing law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
These Terms of Service may be updated from time to time as the product and business evolve. Continued use of the website following updates constitutes acceptance of the revised terms. Material changes will be communicated with reasonable notice.
